Please read these terms carefully before using Tax Amigo. By creating an account or using our services, you agree to be bound by these terms.

1. About Tax Amigo

Tax Amigo is a cloud-based accounting and tax compliance platform operated by Tax Amigo Ltd, a company registered in England and Wales. Tax Amigo is recognised software under HMRC’s Making Tax Digital (MTD) programme. Our service enables self-employed individuals and businesses to manage their accounting, submit VAT returns, and comply with HMRC’s digital tax requirements.

Important: Tax Amigo is accounting software, not a regulated financial adviser. Nothing in this service constitutes tax advice. You remain responsible for the accuracy and completeness of all information submitted to HMRC through our platform.

2. Eligibility and Account Registration

To use Tax Amigo you must be at least 18 years old and either self-employed, a director of a UK-registered company, or an authorised agent acting on behalf of such a person. You must provide accurate registration information including your name, email address, and where applicable your UTR, NINO, or VAT registration number.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorised access to your account.

3. Subscription Plans and Billing

Tax Amigo is offered on the following subscription tiers based on your annual turnover:

All paid plans include a 30-day free trial. No payment details are required during the trial period. Billing begins at the end of the trial period. Subscriptions renew automatically on a monthly basis. You may cancel at any time from Settings → Subscription; cancellation takes effect at the end of the current billing period and no refunds are issued for partial months.

4. HMRC MTD Integration

Tax Amigo integrates with HMRC’s Making Tax Digital APIs. By connecting your HMRC account, you authorise Tax Amigo to submit data to HMRC on your behalf for the specific purposes you select (e.g. VAT returns, Income Tax quarterly updates). You acknowledge that:

  • You are solely responsible for the accuracy of all data submitted to HMRC through Tax Amigo.
  • Tax Amigo will transmit fraud prevention headers to HMRC as required by law with every API call.
  • HMRC may reject submissions that contain errors; Tax Amigo will notify you of rejection reasons but cannot guarantee acceptance.
  • You must maintain your own records as required by HMRC record-keeping obligations (minimum 6 years).
  • Tax Amigo is not responsible for penalties, interest, or other consequences arising from late, incorrect, or incomplete submissions.

5. Acceptable Use

You agree not to use Tax Amigo to:

  • Submit false, misleading, or fraudulent information to HMRC
  • Facilitate tax evasion or any other illegal activity
  • Attempt to reverse-engineer, scrape, or extract data from our systems
  • Share your account credentials with unauthorised third parties
  • Circumvent any security or access control measures
  • Use the service in any way that violates UK law

We reserve the right to suspend or terminate accounts that violate these terms without notice.

6. Data and Privacy

Your use of Tax Amigo is subject to our Privacy Policy, which forms part of these Terms and Conditions. We process your personal data as a data controller under UK GDPR. You have the right to export or delete your data at any time (subject to statutory retention obligations) via Settings → Account.

7. Intellectual Property

All software, content, and trademarks in Tax Amigo are owned by Tax Amigo Ltd or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the service for your own business purposes. You retain ownership of all financial data you input into the platform.

HMRC branding: The term “HMRC recognised” is used solely in accordance with HMRC’s permitted terminology. We do not claim to be “HMRC approved” or “HMRC accredited”. HMRC logos are not used in our software or marketing materials.

8. Limitation of Liability

To the fullest extent permitted by law, Tax Amigo Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to tax penalties, interest charges, or losses arising from HMRC submissions. Our total liability to you shall not exceed the subscription fees paid by you in the 12 months preceding the claim.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Service Availability

We aim to provide a reliable service but cannot guarantee 100% uptime. Scheduled maintenance will be communicated in advance. HMRC API availability is outside our control; we will notify you of known HMRC service disruptions via our status page and in-app notifications.

10. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these Terms and Conditions from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of Tax Amigo after that date constitutes acceptance of the updated terms.
